Acceptance of Terms

Welcome to XThinkTank. These Terms of Service constitute an agreement between you and Hooman Biotechnology (Beijing) Co., Ltd. governing your access to and use of the XThinkTank website, mobile applications, and related services.

Important Notice

  • • By registering, logging in, accessing, or continuing to use the Service, you acknowledge that you have read and agree to these Terms and the Privacy Policy.
  • • If you do not agree to these Terms, please stop using the Service.
  • • The Service is operated for users in mainland China. Access from outside mainland China remains subject to the laws and regulations of the People’s Republic of China and these Terms.
  • • The platform may update these Terms for legal compliance, security and risk control, or product iteration. Material changes will be notified in a reasonable manner.

Operator & Scope

Platform & Operator

  • • XThinkTank is the platform name and product brand.
  • • Hooman Biotechnology (Beijing) Co., Ltd. (华曼生物科技（北京）有限公司) is the operator of the Service, the contracting party, and the entity responsible for legal interpretation.
  • • The official website is https://xthinktank.com, and the mobile app is named XThinkTank.
  • • The company’s registered address, filing, and license information are as published by regulators and displayed on the website.

Covered Services

  • • Web deep research, conversation management, Space content, export, and account and security settings.
  • • Mobile research workbench, conversation history, human-in-the-loop (HITL), export, read-only billing, or purchase capabilities launched in compliance with applicable law.
  • • APIs, back-office tools, notifications, customer support, and other auxiliary features provided by the platform.
  • • Where a separate agreement or enterprise contract exists, that agreement prevails; matters not covered there are governed by these Terms.

Service Description

XThinkTank is a deep-research platform built on artificial intelligence, multi-agent workflows, and retrieval and analysis capabilities. The Service may include intelligent conversation, research planning, information retrieval, report generation, browsing of public results, conversation export, and account management.

Service Status

  • • Some capabilities remain under continuous optimization; feature names, models, quotas, and interfaces may change.
  • • The platform will use commercially reasonable efforts to maintain stability but does not guarantee perpetual, error-free, or uninterrupted availability.
  • • Changes in the cost of models, search, storage, and third-party services may affect pricing and available features.

Nature of Results

  • • AI-generated content is for reference only and is not guaranteed to be complete, accurate, timely, or fit for any particular purpose.
  • • For high-risk matters such as legal, medical, financial, investment, regulatory, or academic-publishing issues, you should consult a qualified professional.
  • • You are responsible for your own judgment and for the consequences of adopting, publishing, distributing, or commercially using AI output.

Platform Adjustments

  • • The platform may adjust the scope of the Service as needed for security, compliance, cost, and product operations.
  • • Adjustments that materially affect user rights will be announced via in-app notice, email, or on-page prompts.
  • • Adjustments required by urgent security or regulatory demands may be implemented first and explained afterward.

Accounts & Minors

Account Requirements

  • • You must provide true, accurate, complete, and reachable information and keep it up to date.
  • • You must safeguard your password, verification codes, two-factor keys, and login devices, and are responsible for activity under your account.
  • • You may not rent, lend, transfer, or sell your account, or use multiple accounts to circumvent quotas, risk controls, or payment rules.
  • • If you detect account anomalies, unauthorized logins, or suspected compromise, promptly change your password and contact the platform.

Use by Minors

  • • The Service is not offered to children under the age of 14. If children’s personal information is found to have been collected inadvertently, the platform will delete or anonymize it in accordance with the law.
  • • Minors aged 14 or older but under 18 should use the Service with the consent and guidance of a guardian.
  • • For activities such as payment, publishing content, export, and public sharing, guardians should be fully informed and bear the corresponding supervisory responsibility.

Acceptable Use

Prohibited Content & Conduct

  • • Generating, distributing, or assisting with content that is illegal or criminal, violent or terroristic, obscene or pornographic, related to gambling or fraud, infringing, false or harmful, or that endangers national security, public safety, or public order.
  • • Uploading, entering, or inducing the platform to process personal information, trade secrets, non-public data, protected works, or third-party confidential information that you are not authorized to process.
  • • Impersonating others, manipulating public opinion, bulk registration, traffic inflation, scraping, reselling the Service, circumventing limits, or committing fraud.
  • • Using the platform for automated attacks, exploitation of vulnerabilities, distribution of malicious code, unauthorized access, reverse engineering, or bypassing security measures.

Security Testing Boundaries

  • • Without written authorization, you may not conduct penetration testing, stress testing, scanning, or vulnerability exploitation against the platform, its interfaces, accounts, payment flows, or third-party services.
  • • If you discover a security vulnerability, report it via ai.ts@xthinktank.com or the contact-support page; do not publicly disclose it or amplify its impact.
  • • The platform may apply rate limiting, verification, suspension, bans, reversal of credited amounts, and other measures to abnormal requests, suspicious transactions, bot activity, and high-risk content.

AI Content & Professional Risk

Limitations of AI Output

  • • AI output may contain factual errors, missing sources, outdated information, logical bias, incomplete citations, or content unsuitable for a specific scenario.
  • • The platform provides source, summary, reasoning, and reporting tools; these do not replace your independent judgment, professional review, or any legally required approval process.
  • • Before publishing externally, submitting, making decisions, or commercializing the output, you should verify its facts, copyright, compliance, and professional suitability yourself.

High-Risk Use

For high-risk uses such as legal advice, medical diagnosis, investment advice, drugs and medical devices, workplace safety, regulatory filings, academic publishing, and news publishing, the platform’s output may serve only as supplementary information. You may not treat the output as the sole basis for a decision, nor make professional conclusions to third parties in the platform’s name.

Credits & Payment

Nature of Credits

  • • Credits are a prepaid digital entitlement used within the platform to consume AI research, model, search, storage, or other digital service capabilities.
  • • Unless otherwise required by laws and regulations or expressly stated by the platform, credits are not equivalent to cash and are non-interest-bearing, non-withdrawable, non-transferable, and not privately tradable.
  • • The current base conversion is CNY 1 = 1,000 base credits; bonus credits from packages, promotional credits, and the actual amounts credited are subject to the purchase page, order records, and platform announcements.
  • • Credits are metered and charged in real time according to actual usage: during task execution, credits are deducted from your available balance based on actual consumption, with no pre-authorization hold and no freezing. Credits already consumed are not returned if a task is interrupted, cancelled, or fails; where a task cannot be fully completed, the platform will generally conclude it by delivering the portion already completed.
  • • Starting a task requires meeting the minimum available balance published by the platform, with the specific figures as published on the platform’s pricing page; if your balance becomes insufficient during execution, the task may conclude early and deliver the portion already completed. Credits held or pre-deducted before this billing rule was adjusted will be settled or released under the rules applicable when they arose.

Payment Channels

  • • Available payment channels on the web are as actually displayed on the payment page. WeChat Pay is currently the primary supported channel; channels such as Alipay do not constitute a promise of availability unless enabled on the page.
  • • Payment services are processed by the relevant third-party payment institutions. The platform does not store your full bank card number, payment account password, or raw payment credentials.
  • • Order creation, payment callbacks, proactive order queries, amount verification, and crediting are determined by the platform’s back-office records and third-party payment records.
  • • If an order is paid successfully but credits are not received, keep the payment time, order number, and payment receipt and contact support.

Refunds & Disputes

  • • Unused topped-up credits may be refunded within a reasonable period; credits corresponding to already-consumed model, search, generation, storage, and other service costs are generally non-refundable, except as otherwise required by laws and regulations.
  • • Package-bonus credits, promotional credits, or compensation credits are not separately redeemable for cash. Upon a refund, the platform may correspondingly reclaim the related bonus entitlements.
  • • For refund requests arising from major platform failures, duplicate or abnormal charges, accidental payments by minors, unauthorized charges, payment-channel anomalies, or circumstances provided by law, the platform will verify and handle them in accordance with the law.
  • • Approved refunds are, in principle, returned via the original payment method; third-party payment institutions, banks, or app stores may affect the crediting time and refundable scope.

Subscriptions

The platform may introduce subscriptions or membership benefits in the future. Subscription, auto-renewal, cancellation, refunds, downgrade of benefits, and expiration handling will be specified via a separate page or supplementary terms before launch. Until such capabilities are officially launched, these Terms do not constitute a promise that subscription or auto-renewal services have been enabled.

Mobile Payment Boundaries

App Store / Google Play

  • • Purchases of credits, subscriptions, or other digital entitlements in the mobile app will be enabled subject to the rules of the App Store, Google Play, and the specific distribution channel.
  • • On channels that require in-app purchase, the platform will not use in-app buttons, deep links, or copy to steer users toward external purchases that circumvent app-store rules.
  • • If credit/point purchases are enabled on iOS in the future, they will be provided primarily through compliant methods such as Apple In-App Purchase, with crediting after server-side transaction verification.
  • • If purchase capabilities are enabled on Android in the future, they will be handled respectively under Google Play Billing, region-specific external-payment programs, or the rules of non-Play distribution channels.

Cross-Platform Account Entitlements

The account balance and history you obtain on the web or through other compliant channels may be displayed and used on mobile. However, displaying a balance does not mean a purchase entry is offered on mobile, nor that a third-party app store participates in or is responsible for transactions it did not process.

Intellectual Property

Platform Rights

  • • XThinkTank’s name, logo, interface, code, documentation, processes, model orchestration, and platform technology are protected by intellectual property and other laws.
  • • Without authorization, you may not copy, adapt, rent, resell, scrape, mirror, or create a competing service.
  • • The platform reserves the right to adjust features, pricing, branding, and presentation as needed for security, operations, and compliance.

User Content

  • • You retain the rights to content you lawfully input, but you must ensure you have the rights to process, upload, and authorize the platform to use such content.
  • • To provide the Service, you authorize the platform to process, store, transmit, display, and generate the relevant content within the necessary scope.
  • • You may not upload materials that infringe intellectual property, privacy, trade secrets, or other lawful rights and interests.
  • • Infringement complaints may be sent to ai@xthinktank.com, with proof of identity, proof of rights, the location of the complained-of content, and preliminary evidence.

Privacy & Security

Privacy Protection

  • • The platform processes personal information in accordance with the Privacy Policy, following the principles of lawfulness, legitimacy, necessity, good faith, purpose limitation, and data minimization.
  • • Through account settings or by contacting support, you may exercise rights such as access, copy, correction, deletion, withdrawal of consent, and account deregistration.
  • • To generate AI research results, the platform may need to transmit necessary data to service providers for models, search, cloud services, payment, and push notifications; see the Privacy Policy for details.

Security & Auditing

  • • The platform employs security measures such as access control, encrypted transmission, log auditing, backups, anomaly detection, and privilege isolation.
  • • Operation logs, payment records, risk-control records, and security-incident records may be retained in accordance with the law for auditing, dispute handling, anti-fraud, and compliance requirements.
  • • No internet service can guarantee absolute security. You should avoid entering unnecessary sensitive information or data you are not authorized to process.

Service Availability

Interruptions & Maintenance

  • • Planned maintenance will be announced in advance where possible; emergency security fixes, regulatory requirements, or third-party failures may not allow advance notice.
  • • Natural disasters, public events, network-carrier failures, third-party service anomalies, payment-channel failures, and user device or network problems may affect the Service.
  • • The platform will use commercially reasonable efforts to restore the Service and may provide credit compensation, service extensions, or other reasonable remedies based on the actual impact.

Limitation of Liability

  • • To the extent permitted by law, the platform is not liable for indirect losses, loss of expected profits, loss of opportunity, loss of goodwill, or losses arising from your own decisions.
  • • For direct losses caused by the platform’s fault, the platform will bear corresponding liability in accordance with the law; liability for personal-information security incidents is not automatically exempted by these Terms.
  • • Aggregate liability shall, in principle, not exceed the total fees you actually paid for the relevant service in the 12 months preceding the dispute, except as otherwise provided by law.

Suspension & Termination

Measures the Platform May Take

  • • For conduct violating laws and regulations, these Terms, platform rules, or security and risk-control requirements, the platform may take measures such as reminders, rate limiting, content removal, feature suspension, order freezing, restriction of withdrawal-style refunds, account bans, and referral to competent authorities.
  • • For serious illegality, infringement, security attacks, payment fraud, bulk abuse, or harm to the rights of the platform and others, the platform may immediately suspend or terminate the Service.
  • • The platform reserves the right to seek recovery, in accordance with the law, for consumed service costs, investigation costs, third-party claims, or regulatory penalties resulting from violations.

Termination by You

  • • You may stop using the Service, request account deregistration, or delete conversation data.
  • • Before deregistration, we recommend exporting necessary data; after deregistration, data not required to be retained by law will be deleted or anonymized.
  • • Records required for payment, invoicing, auditing, disputes, anti-fraud, and regulatory requirements may continue to be retained as provided by law.

Dispute Resolution

Resolution Path

  • • You may first submit an issue via ai@xthinktank.com or the contact-support page, and the platform will review it within a reasonable period.
  • • For matters involving payment, accidental payments by minors, account security, personal information, content infringement, or service failures, please provide the order number, account email, time, screenshots, and necessary evidence.
  • • The parties should first attempt friendly negotiation; if negotiation fails, either party may bring a lawsuit before the competent People’s Court at the operator’s domicile in accordance with the law.

Governing Law

The formation, validity, performance, interpretation, and dispute resolution of these Terms are governed by the laws of the People’s Republic of China, excluding its conflict-of-laws rules. Mandatory rights that consumers enjoy under the law are not excluded or limited by these Terms.

Changes to These Terms

Notice & Your Choices

  • • Material changes may be announced via website notices, in-app notifications, email, login pop-ups, or mobile on-page prompts.
  • • If you disagree with a material change, you may stop using the relevant service before it takes effect and handle unused entitlements under the applicable rules.
  • • General wording improvements, contact-information updates, feature-description synchronization, and urgent security or compliance adjustments may take effect upon page update.
